Terms of Use
The website of the National Information Center for Academic Recognition Japan (the "Website") is operated by the National Information Center for Academic Recognition Japan (the "Center"), under the National Institution for Academic Degrees and Quality Enhancement of Higher Education.
The Center's website terms of use (the "Terms of Use") provide for the conditions of use of the Website and the rights and obligations between You and the Center. Please read the entire text of the Terms of Use and only use the Website if You agree to the Terms of Use.
By using the Website, You are deemed to have agreed to all of the conditions of use set forth below.
Article 1 (Application)
- The Terms of Use provide for the rights and obligations between You and the Center with regard to the use of the Website (https://www.nicjp.niad.ac.jp) and apply to the entire relationship between You and the Center with regard to the use of the Website.
- In the event of any conflict between the Terms of Use and an explanation of the Services or any other information provided outside the Terms of Use, the Terms of Use prevail.
Article 2 (Definitions)
As used in the Terms of Use, the following terms have the respectively provided meanings:
- "Center" means the National Information Center for Academic Recognition Japan, under the National Institution for Academic Degrees and Quality Enhancement of Higher Education.
- "User" or "You" means an individual or corporation that uses the Website in accordance with the Terms of Use.
- "Website" means the website operated by the Center, with the domain name "nicjp.niad.ac.jp" (if the domain name of the Center's website has been changed for whatever reason, it includes the website after the change).
- "Services" means the provision of "information on the educational system of Japan," "a list of higher education institutions," and "information on the educational systems of foreign countries (such as the State Parties of the Tokyo Convention)" on the Website by the Center, and "response to various inquiries" using the inquiry form on the Website (if the domain name of a service has been changed for whatever reason, it includes the service after the change).
- "Intellectual Property Rights" means copyrights, patent rights, utility model rights, design rights, trademark rights, and any other intellectual property rights (including the right to obtain these rights or the right to file an application for registration, etc. of these rights).
Article 3 (Prohibited Acts)
- You must not commit an act that falls under or that the Center determines to fall under any of the following items in using the Services:
- An act in violation of a law or regulation, or an act associated with a criminal act.
- An act of fraud or intimidation against the Center, another User of the Services, or any other third party.
- An act which is contrary to public order and morality.
- An act of infringement on Intellectual Property Rights, portrait rights, privacy rights, reputation, or any other rights or interests of the Center, another User of the Services, or any other third party.
- An act of transmitting to the Center or to another User of the Services information that falls under or that the Center determines to fall under any of the following categories through the Services:
- Information containing violent or atrocious expressions.
- Information containing a computer virus or any other harmful computer program.
- Information containing expressions that damage the reputation or trust of the Center, another User of the Services, or any other third party.
- Information containing obscene expressions.
- Information containing expressions that promote discrimination.
- Information containing expressions that promote suicide or self-injury.
- Information containing expressions that promote inappropriate use of drugs.
- Information containing antisocial expressions.
- Information requesting forwarding of information to third parties, such as chain letters.
- Information containing expressions that cause discomfort to others.
- An act of placing excessive burden on the network or system, etc. of the Website.
- An act of reverse engineering or otherwise analyzing software or any other systems provided by the Center.
- An act that is likely to obstruct the operation of the Services.
- An act of unauthorized access to the network or system, etc. of the Center.
- An act of spoofing.
- An act of using information of another User of the Services.
- An act of publicity, advertising, solicitation, or sales on the Services without advance permission by the Center.
- An act of collecting information of another User of the Services.
- An act that causes detriments, damage, or discomfort to the Center, another User of the Services, or any other third party.
- An act in violation of the rules concerning the use of the Services published on the Website.
- An act of giving benefits to antisocial forces, etc.
- An act of directly or indirectly inducing or facilitating the act referred to in any of the preceding items.
- An act of attempting to commit the act referred to in any of the preceding items.
- Any other act that the Center determines to be inappropriate.
- If Your act violates any of the items in the preceding paragraph, the Center may prohibit You from using the Services without any warning.
Article 4 (Discontinuation of the Services)
In the event of any of the following cases, the Center reserves the right to discontinue or suspend the provision of all or part of the Services without giving You prior notice. The Center is not liable to compensate for any damage You incur as a result of the discontinuation or suspension, unless You are categorized as the consumer under the Consumer Contract Act of Japan and the damage was caused by the Center's willful misconduct or gross negligence.
- A case of performing emergency inspection or maintenance of a computer system relating to the Services.
- A case where the Services cannot be operated due to failure, erroneous operation, excessive access concentration, unauthorized access, hacking, etc. of a computer or communication line.
- A case where the Services cannot be operated due to force majeure, such as an earthquake, lightning strike, fire, storm, flood, blackout, or natural disaster.
- Any other case in which the Center determines discontinuation or suspension to be necessary.
Article 5 (Attribution of Rights)
All Intellectual Property Rights concerning the Website and the Services are attributable to the Center or to those who grant licenses for those rights to the Center. The permission to use the Services under the Terms of Use does not mean permission of use of the Intellectual Property Rights concerning the Website or the Services held by the Center or by those who grant licenses for those rights to the Center.
Article 6 (Change to the Content of or Termination of the Services)
- The Center may change the content or terminate the provision of the Services due to the Center's circumstances. The Center is not liable to compensate for any damage You incur as a result of the change or termination of the Services, unless You are categorized as the consumer under the Consumer Contract Act of Japan and the damage was caused by the Center's willful misconduct or gross negligence.
- When the Center terminates the provision of the Services, the Center is to give You prior notice.
Article 7 (Disclaimer and Waiver of Warranties)
- The Center makes no warranty of any kind, express or implied, with respect to the following: that the Services fit Your particular purpose; that the Services have the expected functions, commercial value, accuracy, or usefulness; that the use of the Services complies with the laws and regulations applicable to You or any internal rules established by industrial organizations; and that the Services will be free of interruption or defects.
- The Center is not liable to compensate for any direct, incidental, indirect, special, future, or lost profit damage You incur in relation to the Services, unless You are categorized as the consumer under the Consumer Contract Act of Japan and the damage was caused by the Center's willful misconduct or gross negligence.
- You are to resolve on Your own responsibility any transactions, communications, or disputes arising between You and another User or a third party in connection with the Services or the Website.
Article 8 (Confidentiality)
You are to keep confidential any information disclosed by the Center for which the Center has imposed on You a confidentiality obligation in connection with the Services, unless You have obtained prior written approval from the Center.
Article 9 (Treatment of User Information)
- In the case where You make an inquiry by using the "inquiry form" on the Website, You need to enter Your user information ("User Information").
- The Center treats User Information in accordance with the provisions of the Center's Privacy Policy (https://www.nicjp.niad.ac.jp/en/privacy-policy/index.html), which are separately prescribed, and You are hereby deemed to agree to the fact that the Center treats User Information in accordance with that Privacy Policy.
- The Center may, at its discretion, use or make public any information or data You provide to the Center, as statistical information in a form that cannot identify an individual, and You may not challenge or dispute such use.
Article 10 (Amendments to the Terms of Use)
The Center reserves the right to amend the Terms of Use if the Center finds it to be necessary. In the case of amending the Terms of Use, the Center publicizes the time when the amended Terms of Use become effective and the content thereof by posting the information on the Website or by any other appropriate method, or gives You notice of the information. However, if amendment is made to content that requires Your consent under laws and regulations, the Center obtains Your consent by the method prescribed by the Center.
Article 11 (Communication/Notice)
Any inquiries with respect to the Services or other communications or notices from You to the Center, or the notices concerning any amendment to the Terms of Use or other communications or notices from the Center to You are made by the method specified by the Center.
Article 12 (Assignment of Status concerning the Use of the Services)
- The Registered User may not assign, transfer, grant security interests in or otherwise dispose of its status under the service agreement or its rights or obligations under the Terms of Use without the prior written approval of the Center.
- If the Center assigns the business regarding the Services to a third party, the Center may, as part of such assignment, assign to the third party its status under the service agreement, its rights and obligations under the Terms of Use, and User Information, and You are hereby deemed to agree to such assignment in advance. The business assignment provided for in this paragraph includes, in addition to the usual form of business assignment, a split of the organization or any other case that results in a business transfer.
Article 13 (Severability)
If any provision of the Terms of Use or part thereof is held to be invalid or unenforceable under the Consumer Contract Act of Japan or other laws or regulations, the remaining provisions of the Terms of Use and the remaining part of the provision that is held to be invalid or unenforceable in part will remain in full force and effect.
Article 14 (Governing Law and Jurisdiction)
- The Terms of Use are governed by the laws of Japan.
- Any and all disputes arising out of or in connection with the Terms of Use are to be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.
